The ONLY Acceptable Gun Control Law

There is only one possible Federal Gun Control law that should be thought of by everyone in the United States of America. However, most Americans do not know much of anything about the Declaration of Independence, the US Constitution, and the US Code. If they did or actually researched what these three documents state, then I believe most open-minded people would agree with me. Oh, yes, I haven't stated what the Federal Gun Control law is that I support and find being the only acceptable law. That law would be the law that REQUIRES all able-bodied males between the ages of 17 and 45 and women in the National Guard to carry a gun and proper ammunition for that gun at all times.


Let us start this discussion with the Declaration of Independence as that is the founding document of the United States. It states in the relevant part:

We hold these truths to be self-evident, that all men are created equal, that they are endowed by their Creator with certain unalienable Rights, that among these are Life, Liberty and the pursuit of Happiness.--That to secure these rights, Governments are instituted among Men, deriving their just powers from the consent of the governed, --That whenever any Form of Government becomes destructive of these ends, it is the Right of the People to alter or to abolish it, and to institute new Government, laying its foundation on such principles and organizing its powers in such form, as to them shall seem most likely to effect their Safety and Happiness. Prudence, indeed, will dictate that Governments long established should not be changed for light and transient causes; and accordingly all experience hath shewn, that mankind are more disposed to suffer, while evils are sufferable, than to right themselves by abolishing the forms to which they are accustomed. But when a long train of abuses and usurpations, pursuing invariably the same Object evinces a design to reduce them under absolute Despotism, it is their right, it is their duty, to throw off such Government, and to provide new Guards for their future security.

What does this text mean? This is the very text that states it is the right and arguably the responsibility of the governed (people) to overthrow a government that is evil and destructive. The governed cannot do so, if the people are completely disarmed. If the colonies in 1776 had no guns, then the United States would never have been formed as it was the American Revolution that created this country.


Next, we get into the Second Amendment of the United States Constitution. It states:

Amendment II
A well regulated Militia, being necessary to the security of a free State, the right of the people to keep and bear Arms, shall not be infringed.

Now, let's parse this amendment's text. It states that there needs to be "a well-regulated Militia". This is a group of people that can be quickly called together to defend the country as they are ready and armed to do so. It also states that this Militia is there because of it "being necessary to the security of a free State". This means that if the people want to secure their Rights they need to be free and secure in that freedom. You cannot have any freedom if you cannot defend yourself from your government or anyone else out to harm you or your country. Then we have the statement of "the right of the people to keep and bear Arms". This is the statement that we have the right to be armed and that we need to be armed to maintain our freedom and security. And, finally, the most important part is "shall not be infringed". The meaning of this is there shall not be any restriction on the people being armed. Current Gun Control laws and proposals fly in the face of the text of the Second Amendment and can lead to the very oppression that the Founders of the United States fought against and gained independence from.


Now, we get into the basis of my idea of Gun Control: Title 10 USC, Subtitle A, Part I, Chapter 12, Section 246. It states:

§246. Militia: composition and classes
(a) The militia of the United States consists of all able-bodied males at least 17 years of age and, except as provided in section 313 of title 32, under 45 years of age who are, or who have made a declaration of intention to become, citizens of the United States and of female citizens of the United States who are members of the National Guard.
(b) The classes of the militia are-
(1) the organized militia, which consists of the National Guard and the Naval Militia; and
(2) the unorganized militia, which consists of the members of the militia who are not members of the National Guard or the Naval Militia.

All able-bodied males between ages 17 and 45 and women in the National Guard are members of the militia. This means that they cannot be prevented from having a gun and any gun control laws can be argued to prevent them from being able to perform their duties as members of the militia. By requiring these people to carry a gun and proper ammunition at all times, we enable them to carry out their duties and be rapid response in cases of gunmen attacking soft targets such as schools and can prevent tragedies like 17 people killed because the Sheriff Deputy on duty at the school fails to enter when the shooting starts. Anything else creates and atmosphere where these tragedies become commonplace and no amount of the current gun control laws and proposals will prevent them. And, then it becomes possible for the government to then ignore the rest of the Bill of Rights and take away those Rights from EVERYONE, while using the tragedies as excuses for doing so.

Thank you for the clarity of what our founders intended. Only in the minds of a liberal anarchists, do these words ring hollow. Interesting tho.....that for that same crowd, the twisted ammendment supporting abortion rights, is forever to be accepted as original intent.....when, nothing if further from reality.

Great article clearly defining where citizens rights and responsibilities stand. Modern day Americans occasionally need to be reminded why we have these rights and what the alternatives are. Lest We Forget.
